Defense attorney for Jeffrey Epstein
Marc Allan Fernich is a prominent New York City criminal defense attorney and one of Jeffrey Epstein's defense lawyers. Fernich is not a suspect, victim, or subject of any criminal proceedings in the Epstein case — his role is entirely as a member of Epstein's legal defense team. Following Epstein's death in custody at the Manhattan Correctional Center on August 10, 2019, Fernich issued a highly publicized statement blaming multiple parties for what he called an "unthinkable tragedy." He criticized "overzealous prosecutors," "pandering politicians," "compliant judges," and a "hysterical press corps," asserting that all "seem to have a share of Mr. Epstein's blood on their hands." He also argued that jail officials "recklessly put Mr. Epstein in harm's way" and failed to protect him. Fernich characterized his statements as the personal views of an "outraged citizen and defense lawyer," not the official position of Epstein's entire legal team. Fernich is one of New York's most prominent criminal defense attorneys, with approximately 25 years of experience. He lists Jeffrey Epstein, Mexican drug cartel leader Joaquin "El Chapo" Guzman Loera, and convicted mobster John "Junior" Gotti among his notable clients on his firm's website. He later joined the legal team of Keith Raniere, the convicted NXIVM sex cult leader, and accepted a $25,000 (later $50,000) payment from Congressman Matt Gaetz's campaign fund in 2021 while Gaetz was under federal sex trafficking investigation. There is no evidence that Fernich himself was arrested, charged, convicted, investigated, or otherwise held legally accountable in connection with the Epstein case. His connection to the case is solely in his professional capacity as Epstein's defense counsel.
