Michael Thomas was a correctional officer at the Metropolitan Correctional Center who was on duty when Jeffrey Epstein died in custody on August 10, 2019. On November 19, 2019, federal prosecutors in New York indicted Thomas on three counts of falsifying records and one count of conspiracy to falsify records. According to evidence obtained by prosecutors, Thomas and his partner Tova Noel failed to check on Epstein for eight hours, instead making personal computer searches and sleeping, while repeatedly signing records falsely affirming they had performed required checks. In May 2021, Thomas entered into a deferred prosecution agreement allowing him to avoid conviction and sentencing if he complied with specific terms including community service and maintaining good behavior. In June 2021, prosecutors formally dropped the charges against Thomas following his completion of the deferred prosecution agreement requirements.
